Jennifer O’Leary enjoys a varied civil litigation practice as a member of our Insurance, Local Government, Transportation, and Information/Privacy practice groups, and our Subrogation Recovery Team.

Jennifer defends municipalities, schools, hospitals, professionals, and commercial clients with an emphasis on those in the hospitality, transportation and entertainment industries, both directly and through their insurers. No two files are exactly the same, and Jennifer’s goal is to learn each client’s priorities on each file so that she can work for the outcome that is best for them.

Jennifer also brings subrogated claims for insurers and insureds, as a member of the firm’s Subrogation Recovery Team. During her legal studies, Jennifer participated in the mediation program and while she does not work as a mediator, that background, and alternating between defence and plaintiff files, gives her insight into different parties’ interests, and often allows her to find creative solutions where none appear to exist.

Jennifer’s work with public bodies has led her naturally into Information/Privacy and she represents clients both before and during the review request process with the Office of the Information and Privacy Commissioner.

On A Personal Note...

In her pre-law life, Jennifer studied business (marketing) and took those skills to London where she also studied, she appeared in the long-running dinner theatre show, Tony ‘n Tina’s Wedding in Vancouver, taught English both formally and as a voice over and children’s performer in Taiwan, and briefly studied acting in Los Angeles. Jennifer’s principal recreational activity these days is trying to keep up with her young godson, by improving her video game play and learning to use a 3-d printer. She is working hard towards the day when they play Mario and he does not have to tell her to “get in your bubble!!”.

Representative Experience

Jennifer has appeared in the British Columbia Supreme Court, British Columbia Supreme Court Chambers, British Columbia Provincial Court and in dispute resolution processes before the British Columbia Human Rights Tribunal and British Columbia Provincial Court.

Recent Decisions

  • Jordison v. Axa Pacific Insurance: Successful defence of insurance company in Provincial Court claim for coverage
  • Bagadiong v. Protrans BC Operations Ltd.: Successful defence of transportation authority which runs the Canada Line in Vancouver in Provincial Court action by passenger alleging she slipped and fell on water in a Canada Line Station
  • Eftetahi v. Souroriyan and Rezezadeh: Successful defence of two insurance brokers in action commenced by policy holder alleging negligent and fraudulent misrepresentation by agents during sale of insurance policy
  • Mohamed v. Protrans Operations BC Ltd. et. al.: Successful defence of transportation authority which operates the Canada Line in Vancouver in personal injury action brought by passenger alleging misleading signage
