Property Assessment Appeals
The tax burden associated with escalating property assessments requires entities with significant property portfolios to be vigilant in the property assessment process. We provide advice and representation in real property assessment for commercial, industrial and individual property owners on property tax matters. Our clients are drawn from a diverse group that includes building owners, hospitals, telecommunication companies and resource companies amongst others. Our experience in this area includes representing clients before the Property Assessment Appeal Board, the B.C. Supreme Court and Court of Appeal, and the Supreme Court of Canada.
Recent Representative Matters
- Negotiated multiple interface agreements with the constructor and operator of a light rapid transit system on behalf of a client in the transportation sector;
- Negotiated a range of contract documents in relation to the construction of a major hospital facility as a public private partnership on behalf of a major stakeholder;
- Negotiated various construction and lease agreements relative to a number of care facilities established as public private partnerships on behalf of a major stakeholder;
- Represented the purchaser of a major downtown Vancouver office tower;
- Represented a joint venturer in litigation involving a major property development;
- Assisted a landlord in terminating a lease and suing for future rent;
- Represented the real estate development subsidiary of a major financial institution in the development of numerous condominium and mixed-use projects;
- Represented the purchaser in a significant acquisition structured as a purchase of bonds issued under a registered trust deed; and
- Represented various property owners in a successful appeal of their property tax assessments.
